Among them are the fact that the "extremely limited number of companies in this field and their repeated interactions in the bid process in multiple states means that they know much about one another's practices and previous bids," Crawford noted. "No one involved in this case is attending the rodeo for the first time."In addition, according to Crawford, the losing company is only at risk of losing money by not getting the contract, which it could recover if it filed a successful lawsuit."If there is more to the case than appears at present and Scientific Games is able to mount a successful challenge to the bid process on grounds not presently known, all it has lost is money," Crawford wrote. A spokesman for Scientific Games said in a statement that it does not plan on filing such a lawsuit."As we argued in court, and as the judge seemingly agreed, the State's current statutory procurement process deprived us of the ability to effectively demonstrate that this procurement may have been flawed.
